U.S. Court of Appeals Case No: 08-3912
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Shepherd, Author, with Wollman and Hansen, Circuit Judges]
Criminal case - Criminal law. Where defendant's plea was not the product of negotiations with the government and was a plea to the court, the court's questions regarding the circumstances of defendant's plea are not covered by Rule 11(c)'s prohibitions on judicial participation in plea agreements; district court could rely on defendant's false statement during the plea colloquy in deciding to impose an enhancement for obstruction of justice and use of the statement did not violate defendant's right against self-incrimination.
