U.S. Court of Appeals Case No: 08-3920
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Melloy, Author, with Chief Judge Riley and Wollman,
   Circuit Judges]
Criminal Case - conviction. District court did not abuse its discretion in admitting evidence by defendant's roommate of defendant's prior possession and discharge of rifle in charge of felon in possession of a firearm, as evidence showed ownership or control of the gun and logically tended to prove an element of the crime charged. Testimony was neither constructive amendment to or a variance of the indictment. Any error in admitting evidence by officer relating to the execution of the search warrant was harmless. District court did not clearly err in rejecting Batson challenges.
