U.S. Court of Appeals Case No: 08-3979
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Melloy, Author, with Loken, Chief Judge, and
Murphy, Circuit Judge]
Criminal case - Sentencing. Even if the district court erred in holding
that a conviction for a walkaway escape qualifies as a crime of violence,
the error in applying the guidelines was harmless as the court sentenced
defendant below the career-offender guidelines and within the range that
would have applied had the court found the career-offender provisions
inapplicable; the court's comments leave no doubt that it would apply the
same sentence regardless of whether the career-offender provisions
applied; sentence was not unreasonable.
