Bankruptcy Appellate Panel. Bankruptcy Court erred in sustaining the
trustee's untimely objections to debtor's claim for homestead
exemptions; court clearly erred in finding the trustee had met his burden
of proving the debtor claimed the exemptions in bad faith; order
disallowing exemptions in real estate and stock reversed, and the case
remanded for further proceedings; in the event of a sale of the stock by
the trustee, debtor is entitled to receive up to $11,000 of the proceeds
pursuant to his allowed wildcard exemption.
