U.S. Court of Appeals Case No: 09-1010
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Benton, Author, with Colloton, Circuit Judge, and
Piersol, District Judge]
Criminal case - Criminal law. Excessive window tint on defendant's
vehicle, a violation of Iowa law, provided probable cause for a traffic
stop; officers did not exceed the permissible scope of the stop as the stop
was reasonable in length; despite defendant's limited English-speaking
abilities, the police reasonably believed defendant understood their
questions and was agreeing to a search, and his consent to the search was
valid, and the evidence found during the search was admissible.
