U.S. Court of Appeals Case No: 09-1027
and No: 09-1028
U.S. District Court for the Northern District of Iowa - Sioux City
[PUBLISHED] [Gruender, Author, with Loken, Chief Judge, and
Benton, Circuit Judge]
Criminal case - Criminal law. For the court's earlier opinion in the
matter, see U.S. v. Bertling, 510 F.3d 804 (8th Cir. 2007). On remand, the
district court erred in sentencing defendants based in part on its finding
the defendants did not intended to influence, obstruct or impede the
administration of justice, as that issue was no longer open to debate in
light of this court's directions to reinstate the jury verdicts; case
remanded for resentencing.
