U.S. Court of Appeals Case No: 09-1069
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Murphy, Author, with Smith and Benton, Circuit Judges]
Civil case - Class Actions. In the context of multi-district litigation,
certification in a state court of the same class under the same legal
theories previously rejected by the federal district court presents an issue
sufficiently identical to warrant issue preclusion under federal common
law, and the district court did not err in granting defendants' motion for
an injunction prohibiting relitigation of the certification issue in state
court.
