U.S. Court of Appeals Case No: 09-1072
   District of Nebraska - Lincoln
[PUBLISHED] [Shepherd, Author, with Bye and Beam, Circuit Judges]
Criminal Case - suppression. First search warrant was supported by probable cause notwithstanding omission of on-going drug investigation. First search did not exceed the scope of the search warrant, as warrant permitted search for any indicia of venue evidence and thus search of hidden places constituted lawful search and evidence discovered was not fruit of illegal search. Even if officers exceeded the scope, contraband would have been inevitably discovered as a result of second warrant. Judge Bye concurs.
