U.S. Court of Appeals Case No: 09-1317
U.S. District Court for the Western District of Missouri - Springfield
[PUBLISHED] [Gruender, Author, with Melloy and Beam, Circuit Judges]
Criminal Case - Suppression. Search of glove box incident to a traffic
stop after officers conducted pat-down of the passengers, including the
defendant, was justified because a reasonably prudent officer on the scene
would be warranted in believing that defendant and his unsecured
passengers were dangerous and might access the vehicle to gain
immediate control of weapons. No need to consider whether officer
lacked probable cause to search the vehicle under the automobile
exception.
