U.S. Court of Appeals Case No: 09-1344
and No: 09-1518
National Labor Relations Board
[PUBLISHED] [Murphy, Author, with John R. Gibson and Riley, Circuit Judges]
Petition for Review - NLRB. The Board did not err in refusing to admit
evidence concerning a union's national organizing campaign as the
national union's acts or objectives cannot be imputed to an individual
employee and were irrelevant to the question of whether the particular
employees' activities were protected; no error in refusing to require
production of third party notes; Board's finding that Cintas violated the
Act by interfering with the employees' right to organize was supported by
substantial evidence.
