U.S. Court of Appeals Case No: 09-1364
U.S. District Court for the Northern District of Iowa - Cedar Rapids
[PUBLISHED] [Chief Judge Riley, Author, with Wollman and
Shepherd, Circuit Judges]
Criminal Case - sentence. Following remand to consider amended crack
cocaine guidelines, district court did not plainly err in sentencing
defendant to same sentence. District court was not required to sentence
defendant at bottom of revised range, accounted for substantial assistance
downward departure, and stated it considered all the section 3553(e)
factors. Sentence was not substantively unreasonable.
