091367P.pdf 12/03/2009 United States v. Myron Sawyer
U.S. Court of Appeals Case No: 09-1367
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Bye, Author, with Smith and Colloton, Circuit Judges]
Criminal Case - conviction and sentence. District court did not err in refusing to suppress evidence, as police had a reasonable articulable suspicion to detain Sawyer, and his right to remain silent was not violated. The district court did not abuse its discretion in sentencing Sawyer, as district court did not err in applying the career offender provision because Arkansas robbery qualifies as a crime of violence under section 4B1.2(a)(1).
