U.S. Court of Appeals Case No: 09-1389
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Benton, Author, with Murphy and Smith, Circuit Judges]
Criminal case - Criminal law and sentencing. Owner of home where
defendant stayed overnight was not a government actor for Fourth
Amendment purposes when she gathered defendant's clothing items from
her laundry room and gave them to the police; evidence was sufficient to
support defendant's bank robbery convictions; imposition of consecutive
sentences for defendant's three convictions for using a firearm in
connection with a crime of violence did not violate the Eighth
Amendment's prohibition against cruel and unusual punishment.
