U.S. Court of Appeals Case No: 09-1408
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Wollman, Author, with John R. Gibson and Shepherd,
Circuit Judges]
Criminal case - Criminal law. Information contained in the affidavit
submitted in support of the search warrant application raised a fair
probability that a search of defendant's apartment would result in the
discovery of child pornography; eighteen month period between
undercover agent's last interaction with defendant and the warrant, while
not insignificant, was hardly unprecedented and did not require a holding
that the evidence submitted in support of the warrant was stale.
