U.S. Court of Appeals Case No: 09-1454
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Gruender, Author, with Melloy and Beam, Circuit Judges]
Criminal case - Criminal Law and Sentencing. There was sufficient
evidence to support Coleman's convictions for conspiring and possessing
with intent to distribute crack cocaine, based on evidence of repeated
sales and his active participation in the drug operation. Actual testimony
and inferences from other evidence was sufficient to support proof of
quantity of crack cocaine. Participation in May 9 sale was sufficient to
support conviction for aiding and abetting the possession with intent to
distribute. District court did not abuse its discretion in excluding the
testimony of the proposed expert witness.
