U.S. Court of Appeals Case No: 09-1456
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED][Riley, Author, with Smith and Shepherd, Circuit Judges]
Criminal case - criminal law. For the court's prior opinion in the matter, see U.S. v. Castellanos, 518 F.3d 965 (8th Cir. 2008). On remand, the district court did not err in finding that the evidence seized during a post-warrant search was admissible under the independent source doctrine; the district court had jurisdiction to decide issues left open by the court's mandate and to reopen the record on those issues; the government's argument that the evidence was admissible under the independent source doctrine did not raise a new issue on remand.
