U.S. Court of Appeals Case No: 09-1552
and No: 09-1556
and No: 09-1558
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Bye, Author, with Beam and Colloton, Circuit Judges]
Criminal case - criminal law and sentencing. Evidence was sufficient
to support defendants' convictions for conspiring to impede a judicial
officer in the discharge of her duties and for obstruction of justice; the
First Amendment does not protect a true threat, and defendants'
convictions did not violate their First Amendment rights; no error in
refusing defendant Beale's instructions on his religious beliefs as they
were not placed at issue in the trial; district court did not err in
determining defendant Beale knowingly and intelligently waived his right
to counsel; district court considered relevant Sec. 3553(a) factors at
sentencing; failure to call the judge who was the object of the threats did
not violate defendants' Sixth Amendment Confrontation Clause rights.
