U.S. Court of Appeals Case No: 09-1570
U.S. District Court for the District of South Dakota
[PUBLISHED] [Bye, Author, with Beam and Colloton, Circuit Judges]
Criminal Case - conviction and sentence. District court did not err in
finding warrantless search of hotel room and automobile supported by
probable cause and exigent circumstances, and subsequent search was not
tainted. Photo lineup was not impermissibly suggestive because some
photos showed men with facial hair. District court did not clearly err in
denying Batson challenge, as valid, race-neutral reasons were given for
peremptory strikes. Findings of drug quantities were not clear error.
