Civil case - Fraud. District court did not err in granting bank's motion
for summary judgment on plaintiff's fraud claims in connection with a
loan deal as plaintiff failed to show the bank made any false
representations or that it justifiably relied on any fraudulent
misrepresentations; district court did not err in granting bank summary
judgment on plaintiff's negligent misrepresentation claim as the deal was
an adversarial arm's length transaction and plaintiff failed to show that
the bank was in the business or profession of supplying information in a
nonadversarial capacity to plaintiff.
