U.S. Court of Appeals Case No: 09-1719
U.S. District Court for the Western District of Arkansas - Texarkana
[PUBLISHED] [Colloton, Author, with Smith, Circuit Judge, and
Kornmann, District Judge]
Civil case - ERISA. Plan administrator did not abuse its discretion by
deciding to offset plaintiff's disability benefits by the amount of benefits
he received from the Department of Veterans' Affairs as the benefits
were for the same disability and the plan administrator's decision that
exceptions to the offset provisions of the plan did not apply was a
reasonable interpretation of the plan.
