U.S. Court of Appeals Case No: 09-1758
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Melloy, Author, with Riley, Chief Judge, and
Wollman, Circuit Judge]
Civil case - Employment Discrimination. Plaintiff failed to establish
that he was subjected to a racially hostile work environment; assuming
plaintiff made a prima facie case of race discrimination, defendant
established legitimate, non-discriminatory grounds for its disciplinary
actions which plaintiff failed to show were pretexts for race
discrimination; similarly, defendant failed to show the offered grounds
were pretexts for age discrimination, and the district court did not err in
granting defendant a summary judgment on the claims.
