U.S. Court of Appeals Case No: 09-1775
District of Nebraska - Omaha
[PUBLISHED] [Gruender, Author, with Riley and Hansen, Circuit Judges]
Criminal case - Criminal law. District court erred in granting
defendant's motion to suppress 470 pounds of marijuana seized during a
traffic stop on the ground the trooper who conducted the search did not
have probable cause to believe defendant had committed a traffic
violation; Nebraska Revised Statute 60-6,161(2) required a turn signal to
be given 100 feet before any turn, and when defendant failed to give the
signal the trooper had probable cause to stop the vehicle for a traffic
violation.
