Habeas Case - ineffective assistance of counsel. Conflict of interest claim, based on counsel's representation of defendant and his spouse, added to post-conviction motion beyond the state's 90-day time limit constituted an independent and adequate state procedural rule that is firmly established and regularly followed. Thus the claim is procedurally barred. Petitioner did not established cause to excuse the default. District court's denial of habeas relief is affirmed.
