U.S. Court of Appeals Case No: 09-1901
U.S. District Court for the District of Nebraska - Omaha
[PUBLISHED] [Wollman, Author, with Bye and Melloy,
Circuit Judges]
Criminal Case - conviction. Evidence was sufficient to support
possession of ammunition, as testimony that he was found in possession
of loaded revolver is sufficient evidence he possess the ammunition in the
revolver. District court did not commit plain error when it gave oral
instruction to jury to consider felon in possession of a firearm charge after
it had been dismissed, as there was no indication of juror confusion and
jury had proper written instruction.
