U.S. Court of Appeals Case No: 09-1907
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Gruender, Author, with Melloy and Beam, Circuit Judges]
Criminal case - Sentencing. Defendant's claims of procedural error at
sentencing are rejected as the district court did not treat the advisory
guidelines as mandatory and considered the 3553(a) factors in setting
sentence; in setting defendant's sentence, the district court was not
permitted to give any weight to the severity of the statutory minimum
sentences defendant faced on his firearm counts, and the district court
did not err in rejecting defendant's request to do so; sentence was not
unreasonable.
