U.S. Court of Appeals Case No: 09-1921
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Benton, Author, with Loken, Chief Judge, and Arnold,
   Circuit Judge]
Criminal case - Sentencing. Defendant's conviction for possession of drug paraphernalia was a prior sentence for purposes of Guidelines Sec. 4A1.1; while it was error to grant defendant a two-level, rather than a three-level, reduction for acceptance of responsibility, her sentence was still below the advisory guidelines range which would have resulted from granting three levels, and there was no reasonable probability that the grant of the third level would have resulted in a different sentence.
