U.S. Court of Appeals Case No: 09-1939
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Smith, Author, with Melloy and Colloton, Circuit Judges]
Criminal case - criminal law and sentencing. Evidence was sufficient to
support defendant's conviction for money laundering; the district court
did not err in rejecting defendant's proposed money laundering jury
instruction which defined illicit proceeds as profits from the drug
operation; at sentencing, the district court did not err by including drugs
the conspiracy distributed after defendant was incarcerated as there was
no evidence defendant withdrew from the conspiracy and there was
evidence that he wished to receive some of the proceeds from these sales;
no error in imposing a leadership enhancement under Guidelines Sec.
3B1.1; any sentencing disparity was related to the defendants' unique
roles in the conspiracy and was not unreasonable; Speedy Trial Act claim
was waived by defendant's failure to properly file a motion to dismiss
before trial.
