U.S. Court of Appeals Case No: 09-1942
and No: 09-2036
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Murphy, Author, with Bye, Circuit Judges, and
Goldberg, International Trade Court]
Criminal Case - conviction and sentence. Sufficient evidence was
presented to support that appellants aided and abetted each other in
charge of possession with intent to distribute crack cocaine. District
court did not clearly err in denying Batson challenge, as government
offered a nondiscriminatory explanation for strikes of two African-
Americans. District court did not abuse its discretion in rejecting the
"two conclusions" language in jury instructions. District court's action
in imposing Lewis's sentence were procedurally reasonable and did not
abuse its discretion in rejecting downward variance.
