U.S. Court of Appeals Case No: 09-1943
and No: 09-2330
U.S. District Court for the Southern District of Iowa - Davenport
[PUBLISHED] [Colloton, Author, with Smith, Circuit Judge, and
Kornmann, District Judge]
Criminal case - criminal law and sentencing. Statement defendant
Williams made to police was not admissible under Rule 807; District
court did not err in using the Eighth Circuit pattern instruction on
reasonable doubt; evidence was sufficient to support defendant
McCraney's conviction for drug and firearm offenses; district court did
not err in denying defendant Williams's motion for a new trial on the
ground that the verdicts were against the weight of the evidence; district
court did not err in declining to group counts for sentencing purposes;
district court adequately considered the 3553(a) factors in setting
Williams's sentence; no error in applying career offender guidelines in
setting McCraney's sentence; Williams's sentence was not unreasonable.
Judge Kornmann, concurring in part and dissenting in part.
