U.S. Court of Appeals Case No: 09-1945
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Smith, Author, with Colloton, Circuit Judge, and
Kornmann, District Judge]
Civil Case - civil rights. District court did not err in denying motion for
judgment as a matter of law on claim he was liable for prosecutor's failure
to disclose evidence his relationship because McKinley satisfied the bad
faith standard and misrepresented extent of his relationship to prosecutor.
District court did not err in denying new trial because district court did
not abuse its discretion in restricting evidence of White's escape, in
restricting evidence regarding the prosecutor's recollection of McKinley's
conduct at the deposition, and in restricting evidence from prosecutors
relating to evidence against White or McKinley's investigation. Punitive
damages award was not plain error.
