Civil case - torts. Defendant's failure to perform under a contract
governing transportation of its items cannot support plaintiff's negligence
action for injuries incurred in loading the items; plaintiff chose to load his
truck even though the risks were evident, and defendant did not have any
duty to warn him of that which he should have been known; defendant
was not liable under a premises liability theory as the slope of the lot was
open and obvious as a matter of law.
