U.S. Court of Appeals Case No: 09-1965
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Colloton, Author, with Smith, Circuit Judge, and
   Kornmann, District Judge]
Civil case - torts. Defendant's failure to perform under a contract governing transportation of its items cannot support plaintiff's negligence action for injuries incurred in loading the items; plaintiff chose to load his truck even though the risks were evident, and defendant did not have any duty to warn him of that which he should have been known; defendant was not liable under a premises liability theory as the slope of the lot was open and obvious as a matter of law.
