U.S. Court of Appeals Case No: 09-1997
and No: 09-2075
U.S. District Court for the Eastern District of Missouri - Cape Girardeau
[PUBLISHED] [Shepherd, Author, with Gruender, Circuit Judge, and
Jarvey, District Judge]
Civil case - admiralty. District court did not err in concluding the
parties' contract obligated Fitzgerald to indemnify Ingram for Jones Act
claim arising out of injuries Fitzgerald's employee suffered while trying
to prevent damage to Ingram's tug; because Fitzgerald is contractually
obligated to indemnify Ingram, the district court did not err in denying
Fitzgerald's common law indemnity and contribution claims; award of
attorneys' fees to Ingram is affirmed.
