U.S. Court of Appeals Case No: 09-2004
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Gruender, Author, with Shepherd, Circuit Judge, and
Lange, District Judge]
Civil case - Employment Discrimination. District court did not err in
finding plaintiff had failed to produce direct evidence of pregnancy
discrimination; assuming plaintiff made a prima facie of pregnancy
discrimination under the McDonnell Douglas burden-shifting framework,
the district court did not err in finding defendant had established
nondiscriminatory, legitimate grounds for her discharge - poor
performance and violation of work rules - which plaintiff failed to show
were pretexts for discrimination.
