U.S. Court of Appeals Case No: 09-2018
and No: 09-2295
U.S. District Court for the District of Minnesota - St. Paul
[PUBLISHED] [Riley, Author, with Bright and Wollman, Circuit Judges]
Criminal case - criminal law and sentencing. The record established a
factual basis for defendant Bowie's guilty plea; the district court did not
err in denying his motion to withdraw his plea as Bowie understood his
plea and possible sentence and had not been coerced into making a plea;
Bowie's sentence is affirmed as the district court was not required to vary
downward based on the crack/cocaine disparity; evidence was sufficient
to support defendant Edwards's convictions for drug and firearm
conspiracies; various evidentiary challenges rejected; claim of
prosecutorial misconduct rejected; Edwards's claim that the district court
was biased against him is rejected; no error in denying motion for a bill of
particulars or in denying motion to dismiss the indictment; Edwards's
sentence was not unreasonable. Judge Bright, dissenting with respect to
the affirmance of the defendants' crack sentences.
