U.S. District Court for the Western District of Arkansas - Fayetteville
[PUBLISHED] [Wollman, Author, with Loken, Chief Judge and John
R. Gibson, Circuit Judge]
Civil case - Insurance. Fixed expenses fell within a provision in the
policy which excluded costs that normally would have been incurred in
conducting the business during the same period had the direct physical
loss or damage not occurred, and defendant was entitled to summary
judgment on this claim; chickens which died during a power outage were
not covered under the policy's exclusion for animals, and the district
court did not err in granting defendant summary judgment on this claim.
