U.S. Court of Appeals Case No: 09-2225
U.S. District Court for the Eastern District of Missouri - St. Louis
[PUBLISHED] [Bye, Author, with Murphy, Circuit Judge, and
   Strom, District Judge]
Civil Case - civil rights -qualified immunity. District court did not err in denying summary judgment on the basis of qualified immunity to prison officials on failure to protect claim, as evidence shows a substantial risk of harm to Nelson existed and defendants recklessly disregarded the risk, on failure to provide adequate psychological treatment. as evidence supported official deliberately disregarded need for treatment, and on retaliation/due process claim, as Nelson was transferred after he filed abuse and neglect charge.
