Civil case - Labor Law. NFL players' claims that their suspensions for
testing positive for the presence of bumetanide violated Minnesota's
Drug and Alcohol Testing in the Workplace Act and Consumable
Products Act were not preempted by section 301 of the Labor
Management Relations Act as the claims were predicated on state law,
not the Collective Bargaining Agreement or the League's Policy on
Anabolic Steroids and Related Substances; district court did not err in
finding that the players' common law claims, such as breach of fiduciary
duty, fraud and negligent misrepresentation were preempted by Section
301; district court did not err in confirming arbitrator's award affirming
the NFL's decision to suspend five players who tested positive for
bumetanide.
