Civil case - torts. District court did not abuse its discretion by
determining that plaintiff's claims were ripe for summary judgment;
district court did not err in granting defendant's motion for summary
judgment on plaintiff's false imprisonment claims as plaintiff could not
establish the elements of the tort; district court did not err in granting
American summary judgment on plaintiff's negligence claims as the
claim was precluded by the "conditions of carriage," a contract
controlling the company's duties to plaintiff; as the court need not reach
the question of whether plaintiff's claims are preempted by the Federal
Administration Act and the Americans with Disabilities Act to resolve
the appeal, it would not address American's cross-appeal on the issues.
