Civil Case - diversity; insurance. District court's judgment to insurance
company based on lack of tenant's insurable interest in the property is
reversed, as lack of insurance interest in one of several classes of property
insured under a single policy is not grounds for voiding entire policy.
District court erred in concluding Beckon did not have an insurable
interest in the building, as building had a pecuniary value to Beckon, and
he suffered loss to improvements he made. We decline to rely on state
court decision that is inconsistent with current state law. Any matter of
misrepresentation should be address on remand.
