U.S. Court of Appeals Case No: 09-2464
Appeal from the Bankruptcy Appellate Panel for the Eighth Circuit
[PUBLISHED] [Smith, Author, with Benton and Shepherd, Circuit Judges]
Civil case - Bankruptcy. Bankruptcy Appellate Panel did not err in
finding the trustee's complaint was timely under Rule 9006(a) and 11
U.S.C. Sec. 546(a); the court joins the majority of courts which have held
that Section 546(a) is not jurisdictional and that Rule 9006(a) is the
proper time-calculation method to use when applying Section 546(a)'s
limitations period.
