U.S. Court of Appeals Case No: 09-2483
Appeal from the Bankruptcy Appellate Panel for the Eighth Circuit
[PUBLISHED] [Benton, Author, with Smith and Shepherd, Circuit Judges]
Civil case - Bankruptcy. Bankruptcy Appellate Panel did not err in determining that the entire rent obligation could be claimed as an administrative expense as the language of 11 U.S.C. Sec. 365(d)(3) is unambiguous and requires payment, in full, of post-petition, pre-rejection rent obligations in unexpired leases of nonresidential real property.
