U.S. Court of Appeals Case No: 09-2489
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Smith, Author, with Wollman and Colloton, Circuit Judges]
Civil Case - Americans with Disabilities Act. Common law claims
were properly dismissed under the exclusivity provision of the Minnesota
Workers'' Compensation Act because the injuries resulted from an assault
arising out of activities as an employee. District court did not abuse its
discretion in excluding affidavit that was untimely filed and did not
result in prejudice. District court did not err in concluding Target and
Medcor were not engaged in a joint enterprise under Minnesota law.
