Civil case - ERISA. Plaintiff lacked standing to bring claims with
respect to the ERISA fiduciary's breach of duties concerning the Infuse-
brand bone graft material; while the district court erred in finding plaintiff
did not have standing to challenge the ERISA fiduciary's breach of duties
concerning the Fidelis-brand lead wires for implantable defribillators and
pacemakers, plaintiff failed to state a claim for misrepresentation or
imprudent investment; claims breach of duty of loyalty and breach of the
duty to properly, appoint, monitor and inform the plan committee could
not survive without a sufficiently pled theory of underlying breach.
