U.S. Court of Appeals Case No: 09-2528
U.S. District Court for the District of Minnesota - Minneapolis
[PUBLISHED] [Smith, Author, with Wollman and Benton, Circuit Judges]
Civil case - Anti-fraud injunction statute. In an action by the
government under 18 U.S.C. Sec. 1345 to preserve the assets of the
Petters Company, the district court did not err in denying Ritchie's
motions to intervene as untimely as the litigation has made substantial
progress, Ritchie was aware of the proceedings, its justification for delay
was insufficient and denial of the motion would not significantly
prejudice Ritchie; denial of the motion would not violate Ritchie's due
process rights.
