U.S. Court of Appeals Case No: 09-2532
U.S. District Court for the Eastern District of Missouri - Cape Girardeau
[PUBLISHED] [Shepherd, Author, with Riley, Chief Judge, and Smith,
Circuit Judge]
Criminal case - criminal law and sentencing. Evidence was sufficient to
support defendant's mail fraud convictions, as he made material
misrepresentations to the insurance company in connection with his
submission of false claims for service; the district court recognized its
authority to grant a downward departure, and its discretionary denial of
defendant's request for a departure is unreviewable; district court
adequately addressed the 3553(a) sentencing factors; no error in making
defendant's sentences consecutive; sentence was not unreasonable;
district court did not err in awarding the full amount of the restitution to
the insurer rather than splitting the restitution between the insurer and
defendant's mother's estate.
