U.S. Court of Appeals Case No: 09-2569
U.S. District Court for the Southern District of Iowa - Des Moines
[PUBLISHED] [Smith, Author, with Melloy and Colloton, Circuit Judges]
Criminal case - criminal law. No error in admitting testimony that
manufacturer's inscription on the inside of a safe where contraband was
found matched a safe key in defendant's possession, as the testimony was
not hearsay, and did not violate the best evidence rule; district court did
not err in admitting testimony from the government's fingerprint expert
as defendant failed to show any prejudice from improper notice; evidence
was sufficient to support defendant's conviction for possession of drugs
with intent to distribute.
