U.S. Court of Appeals Case No: 09-2696
U.S. District Court for the Western District of Missouri - Kansas City
[PUBLISHED] [Smith, Author, with Riley, Chief Judge, and Shepherd,
Circuit Judge]
Civil case - Civil Rights. Officers had probable cause to arrest plaintiff
for possession of counterfeit money orders based on a report provided by
Wal-Mart employees; no error in awarding defendant police officers
attorneys' fees as there was no evidence to support plaintiff's Section
1983 claims against them; since the arrest was not unlawful, there was no
basis for an action for false imprisonment; defamation claim was barred
by Missouri's doctrine of qualified privilege; plaintiff cannot show that
Wal-Mart acted with the legal malice necessary to establish a claim for
malicious prosecution.
