U.S. Court of Appeals Case No: 09-2709
U.S. District Court for the Eastern District of Arkansas - Little Rock
[PUBLISHED] [Wollman, Author, with Murphy and Colloton, Circuit Judges]
Criminal case - Sentencing. On remand, the sentencing judge gave
proper consideration to the intent of the original sentencing judge (now
deceased); both of the court's prior remands in this case were general
remands for resentencing which did not place any limits on the discretion
of the newly assigned district court judge in resentencing; in light of the
district court's explanation of the effect of the 3553(a) factors, this court
cannot say the sentence imposed was unreasonable or an abuse of
discretion.
