Civil Case - civil rights. Jury verdict in favor of police officer and City
on claims of excessive force is affirmed. District court did not abuse its
discretion in excluding expert evidence that victim did not have a gun, as
expert based his opinion on his observation of a video and did not assist
the jury. District court should have excluded evidence of victim's gage
membership, but any error was harmless. Verdict form were not
prejudicial and, taken as whole, adequately submitted the issues to the
jury. District court did not abuse is discretion in denying motion for new
trial, as evidence supported verdict.
