Criminal case - Sentencing. For the court's prior opinion in the matter
see United States v. Parks, 249 F. App'x 484 (8th Cir. 2007). Remanded
for reconsideration in light of Chambers v. U.S. in Parks v. United States,
129 S.Ct. 994 (2009). The district court did not err in finding, under the
facts, that defendant's Missouri conviction for escape from a halfway
house was a crime of violence for sentencing purposes; Missouri makes a
distinction between escape from a secured and guarded facility and
escape from an unsecured facility, and defendant's offense fell into the
former category. Judge Melloy, dissenting.
